INSTALLATION AND USE
Marbella brackets are designed to support a maximum load of 40kg when mounted correctly and are for decorative use only. This includes the weight of the shelf. They are not intended for industrial or heavy-duty shelving. Exceeding this weight limit or using the brackets improperly may result in damage or injury, for which Marbella is not responsible.
Marbella will not supply any installation equipment or tools with any of our products unless specified in the check list. Marbella will not take responsibility for any incorrect installation or installation methods used by the client (or service provider client may use), or any damage or injury caused by installing or using the product(s).

Marbella Returns & Refunds :
If you are not entirely satisfied with your product you can return the product to us within 14 days of receipt and we will either exchange it, replace it, or refund you subject to the terms below.
In all cases, the items returned must be in their original condition, which includes any packaging. All items will be inspected on return. The goods are your responsibility until they reach our premises. Please ensure you package your return to prevent any damage to the items or boxes.
We reserve the right to refuse a refund or exchange if the goods returned are deemed to be damaged or tampered with not in accordance with normal use. This does not affect your statutory rights.

Once Marbella has received your item, we will inspect it and notify you that we have received your returned item. We will also notify you of the status of your refund after inspecting the item. If we approve your return, we will refund you via your original payment method. Depending on your bank’s policies, you will receive the credit within a certain amount of days.
You are responsible for organising the return of your item with a courier service of your choice. Don’t hesitate to get in touch with us if you would like a recommendation for courier companies that you can use. You are also responsible for paying for your shipping costs for returning your item, we cannot accept COD packages. Kindly keep the receipt or tracking number of your returned package in the event it is delayed or lost in transit. We cannot be held responsible for items lost or delayed in transit on the way back to us.
Sale items cannot be returned, the same applies for items bought with coupons or on discount.
Marbella products that are custom-made may not be exchanged or returned unless the goods are defective. Additionally, if you have requested any specific changes to an existing listed item on our website, that item will not be suitable for return
Damaged or defective products:
We do our best to ensure that the products we deliver to you are of a high quality and without defects or damage.
If you have received a product which is defective or damaged, please notify us as soon as reasonably possible after you become aware of the defect, but in any event within 2 days after delivery of the product(s).
We will arrange to collect the product from you at no charge.
Once we have inspected the product and validated your return, we will, at your choice, replace the product as soon as possible (if such replacement is possible) or refund you if that is your preference. Refunds are normally handled within 8 days of logging the return (bear in mind that refunds can take 1-4 working days to reflect in your account). Replacements could take longer, depending on replacement availability.
Please provide suitable packaging for returning the product (it need not be the original packaging), as well as all components and parts that were sold with the defective item when you return it to us – regardless of whether you request a replacement or a refund. Our courier is entitled to refuse collection of a product that is not properly packaged for transport

4.6 Because all Marbella products are handmade, products may vary slightly in shape, size, colour, finish compared to the images listed on the website. All products are handmade, one piece at a time. No two pieces will ever be the same due to the handmade nature of our products. Due to the nature of polishing, stone shelves may be slightly shorter in dimension. Any irregularities in our product should not be considered flaws. This includes any and all variation in all stone types.

- Marbella’s ordering process
By accessing or using Marbella websites or services, you signify that you have read, understand, and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”) which indicates that it is the client’s responsibility to double check their order before proceeding to the checkout and the options that they have chosen to make sure that they are 100% satisfied with their choices and that they know what to expect. It is the client’s responsibility to read the terms and conditions any by placing an order it shall be considered your acceptance to the terms and conditions and policies.
You also agree to reach out to the Marbella team before you proceed with your order if you are uncertain about any colour, size or any other information regarding our items. - Marbella’s communication
By accessing or using Marbella’s websites or services you signify that you have read, understand, and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”) that Marbella does not accept any informal way of communication such as Instagram messages, Facebook messages, WhatsApp messages, SMS’s or any other informal communication platform, except email. When any questions are asked, changes need to be made of an order, an email needs to be sent as soon as possible. Your continued use of the Website shall be considered your acceptance that Marbella takes two to three working days to respond to a mail.
8. Marbella’s shipping terms
8.1 By accessing or using Marbella courier services, or the mobile versions of either, (collectively the “Website”) you signify that you have read, understand, and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”) that indicates the following:
8.2 The courier service is an additional service that Marbella provides on a client’s behalf to add to a more convenient shopping experience. In no way is any damages that occurs during the transportation a reflection on Marbella as a company. The client agrees and acknowledges to the following terms and conditions in relation to shipping.
8.3 Marbella takes no responsibility for an incorrect shipment when the wrong delivery address has been provided. The same applies when a client cannot be reached during two delivery attempts.
8.4 All standard shipping costs, including a median fee for nationwide delivery, are included in the listed product price. If the delivery address is considered remote, difficult to access, or falls outside normal courier routes, Marbella reserves the right to reassess and adjust the shipping fee accordingly. Should such a case arise, the customer will be notified in advance of any additional charges prior to dispatch.
9. Marbella’s Competitions
Marbella’s social media competitions, sponsorships or giveaways are in no way endorsed or sponsored by Instagram. All winners and entrants need to comply with the following terms:
· Entrants and winner must be over the age of 18 years old,
· Entrants and winner must reside in South Africa
· Entrants and winner must continue following @marbella-za after the competition ends
· Entrants and winner must have a legitimate Instagram profile, ensued by more than 50 followers and/or a public profile where the page can be reviewed all profiles ensuing less than 50 followers will be deemed illegitimate as per Instagram and fake.
· Marbella’s terms of use, privacy policy and shipping terms apply to all competitions and giveaways.
10. Marbella’s discounts
No discounts, specials or sale prices can be used in conjunction with one another. No discounts will apply to any order if the size of the items is customized.
11. Marbella’s ordering items on sale
No items purchased on sale or a discount is refundable.
12. Custom Designs/Orders
For custom orders, the production lead-time will be communicated with you at the same time of receiving the quote, and production lead-times will vary depending on the scope of the customisation. The client herby agrees, accepts and respects that Marbella makes use of other suppliers and that they also have lead times that Marbella needs to adhere to. Once the final draft of the custom design has been approved by the client, the client has 5 working days to make any last changes. after that, no changes will be allowed.
No custom item is returnable or refundable. It also cannot be swopped out for a store credit of any sort. The same applies to swopping or returning a standard item for a custom item.
